On June 30, 2015, the Pennsylvania General Assembly passed legislation amending Title 23 of the Pennsylvania Consolidated Statutes, which was signed by Governor Tom Wolf on July 1, 2015. Section 6344.2 applies to an adult applying for or holding an unpaid position as a volunteer with a “child-care service, a school, or a program activity or service” responsible for the welfare of a child or having “direct volunteer contact” with children. Section 1 of the amendment defines “direct volunteer contact” as the care, supervision, guidance or control of children and routine interaction with children. The amendment also modified the definition of “program, activity, or service” to include “Any of the following in which children participate and which is sponsored by a school, or a public or private organization” including but not limited to a sports or recreational programs. Employers or other persons responsible for the selection of volunteers shall require an applicant to submit to all requirements set forth in section 6344(b). Employers or other person that intentionally fail to require the foregoing before approving that individual commit a misdemeanor of the third degree.
